1. Agreeing to these terms

These terms govern your use of metrecx.com and any form, portal or communication channel we make available through it. By using the site, you agree to them. If you do not agree, do not use the site.

These terms cover the website. A transaction with Metrecx is governed by the documents signed for that transaction, and those documents control if they conflict with anything here.

2. What Metrecx is, and what it is not

Metrecx Solutions, LLC is a homebuying strategy team. We work on how a home purchase is structured, using private funding, alongside the buyer and the buyer's own real estate agent.

Metrecx is not a bank, a savings institution, a credit union, a mortgage lender, a mortgage broker, or a real estate brokerage. We do not accept applications for credit, we do not make credit decisions, and we do not represent buyers or sellers in a real estate transaction.

Nothing on this site is an offer of credit, a commitment to lend, a commitment to enter any transaction, or a solicitation in any place where doing so would require a license we do not hold.

3. Not advice

Everything on this site is general information. It is not legal advice, tax advice, accounting advice, investment advice, or a recommendation about your particular situation, and no page here creates a professional relationship of any kind.

Before entering any real estate transaction, get advice from your own attorney, your own tax professional, and your own real estate agent. We will tell you the same thing in person. If a transaction structure would not survive your attorney reading it, it should not be in front of you.

4. Who may use this site

You must be at least 18 years old and legally able to enter a contract. The site is intended for use in the United States. We do not represent that the content is appropriate or available anywhere else.

5. Forms and applications

The contact form and the application form on this site are requests for a conversation. Submitting either one does not create an application for credit, an approval, a denial, an adverse action, an enrollment, an obligation to proceed, or any agreement between us.

You agree that the information you give us is accurate and that it is yours to give. Submitting someone else's information without their permission is a misuse of this site.

We pull a consumer report only with your separate written authorization. Where a fee applies to a credit report or to a specific structure, it is disclosed to you in writing before you owe it.

6. Communications and electronic records

By giving us your phone number or email address, you agree that we may contact you about your inquiry at that number or address, including by text message to a mobile number you provide. Message and data rates may apply, message frequency varies, and consent is not a condition of any transaction. Reply STOP to opt out of texts or ask us directly. Reply HELP for help.

You agree that we may provide disclosures, documents and notices to you electronically, and that an electronic signature has the same effect as a handwritten one. You may withdraw that consent by telling us, though some things cannot be done on paper in a reasonable time frame and we will say so if that comes up.

7. Documents and the secure portal

Financial documents and signatures go through our secure portal, not through email or the forms on this site. You agree not to send sensitive documents through a channel we have told you is not secure, and you agree that we are not responsible for information you send outside the channel we provided.

You agree not to upload anything you do not have the right to share, anything containing malicious code, and anything belonging to someone who has not authorized it.

8. Acceptable use

Do not attempt to gain unauthorized access to the site or to any account or system connected to it. Do not scrape, harvest, or systematically collect from the site. Do not interfere with its operation. Do not use it to break a law or to infringe anyone's rights.

9. Content on this site

The text, design, logos and graphics on this site belong to Metrecx or are used with permission. You may read, print and share pages for your own use. You may not republish, resell or present this material as your own.

Where we link to another company's site, we do not control it and we are not responsible for what is on it.

10. No warranty

The site is provided as it is. We do our best to keep it accurate and current, and we do not warrant that it will be error free, uninterrupted, or free of anything harmful. Information here may become out of date. Nothing on this site guarantees that a transaction is available to you, that a structure will work, or that any particular outcome will happen.

To the fullest extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose, and noninfringement.

11. Limits on liability

To the fullest extent the law allows, Metrecx is not liable for indirect, incidental, special, consequential or punitive damages arising out of your use of this site, or for lost profits, lost data, or lost opportunity, even if we were told such damages were possible.

Nothing in this section limits liability that cannot be limited by law, including liability for fraud. Some states do not allow certain limitations, so parts of this section may not apply to you.

12. Indemnity

You agree to cover Metrecx against claims, losses and reasonable legal costs arising from your misuse of this site, your breach of these terms, or your violation of someone else's rights.

13. Governing law and disputes

These terms are governed by the laws of Ohio, without regard to conflict of law rules. Disputes that are not resolved between us will be brought in the courts located in Franklin County, Ohio, and both sides consent to that venue.

14. Fair housing

Metrecx supports the principles of the Fair Housing Act and does not discriminate on the basis of race, color, national origin, religion, sex, familial status or disability.

15. Changes, severability, and contact

We may update these terms. The date at the top of this page shows the current version, and continuing to use the site after a change means you accept it.

If any part of these terms is unenforceable, the rest stays in effect. Our not enforcing something on one occasion does not waive it later.
